Unless it is clearly stated it is a very misleading practice and could potentially violate state and federal deception statutes. You are essentially admitting in your message that it is not clearly stated which could be further interpreted toward the owners culpability. You would be well advised to clarify your policy in a more evident way. As your site appears to have a revenue source in an advertising model you would be very vulnerable to litigaiton.

Aww... come on... have fun with it and leave it at that.  Not understanding what it's about and asking questions is one thing, but this is just complaining.... this site is intended for people that want to enjoy it.
